Last month brought welcome clarification of the law on nuisance in England and Wales, as Biffa was found not to be liable for odours emitted from one of its landfill sites, since it carried out activities in accordance with its environmental permit, and without negligence. The case has helped to clarify the balance of interests in nuisance cases dealing with permitted operations. The judge said it would make a nonsense of the balancing of competing interests in modern nuisance cases if a company could operate in accordance with its permit, receiving glowing reports from the regulator, using BAT and not being negligent, if it could still be liable in nuisance for "inevitable" emissions of odour.
