摘要

Many companies in the waste industry bid for contracts put out to tender by public bodies such as local authorities, councils, police and fire authorities and housing associations. Such public bodies have to follow certain rules when letting contracts, which are informally called the Public Procurement Rules. If public bodies do not follow these rules, unsuccessful bidders can try to have injunctions issued against them to prevent the award of the contract (where the successful bidder has been identified but the contract not yet awarded) and/ or bring a claim against them for damages the unsuccessful bidder has suffered as a result. As the remedies available to unsuccessful bidders formerly only affected the public bodies, generally bidders were not too concerned about whether the public body had followed the Public Procurement Rules (unless they were the unsuccessful bidder and were evaluating whether they might have a claim).
