Defra and the Welsh Assembly Government have published a consultation document entitled Fairer and Better Environmental Enforcement, including proposals to improve environmental enforcement across England and Wales. The consultation seeks views on proposals for a more proportionate, fairer and more effective approach to enforcing environmental law including waste legislation and permitting requirements. The proposed scheme will allow the Environment Agency, Natural England and Countryside Council for Wales to use new civil sanctions under the Regulatory Enforcement and Sanctions Act 2008, providing an alternative to criminal prosecution where, for example, the person or company has a good track record of complying with regulatory requirements.
