REPIC Ltd (REPIC) is a WEEE producer compliance scheme (approved under the Regulations) and in common with other compliance schemes is responsible for financing the costs of the collection, treatment, recovery and environmentally sound disposal of WEEE from private households. REPIC was unhappy that two rival WEEE producer compliance schemes, namely Electrolink Recycling Ltd and WERC Ltd, had intentionally collected far more WEEE than they were legally obliged to do in order to fulfil their obligations under Regulation 22. REPIC alleged that as a consequence of their activities, it was unable to collect sufficient WEEE to meet its obligations under the Regulations and, in those circumstances, it was forced to purchase spare evidence notes at "ransom" prices. It was required to purchase these notes before it could make the appropriate declarations of compliance in respect of the two compliance periods in 2007 and 2008. REPIC alleged that the "over-collection" by these competitors' schemes constituted a breach of paragraph 4 of Part 4 of Schedule 7 to the Regulations.
