Given the concern to control climate change, what role, it any, does waste legislation play in new schemes to capture waste carbon dioxide gases? Article 2(1)(a) of the Waste Framework Directive (2006/12/ EC) excludes from its scope 'gaseous effluents emitted into the atmosphere'.Carbon dioxide (CO_2) emitted as a result of combustion, or other industrial processes, is exempt from waste legislation.Conversely, it is suggested that CO_2 - as a gaseous effluent that is captured, rather than emitted to atmosphere - could be defined as waste.As CO_2 is considered to be a damaging greenhouse gas, emitting it to atmosphere is significantly controlled by bespoke legislation.
