The Environmental Liability Directive 2004/35 (the Directive) establishes a European-wide environmental liability regime, which has been in development over the last 15 years. The main impetus for the development of the regime has been a perceived gap in European environmental law which has meant that, in the aftermath of major pollution incidents, polluters have not been required to fully "compensate" the environment for damage they have caused. This is because traditional forms of legal remedy and regulatory enforcement do not tend to compensate the unowned environment. In other words, whereas polluters can, under existing law, be required to clean up, pay damages and pay fines, they cannot generally be required to make up for permanent damage to wildlife, biodiversity or general water quality.
