As reported in the October 2004 issue of Wastes Management, the European Commission and the European Court of Justice (ECJ) are actively pursuing a number of EU member states for alleged infringements of EU waste and environment law. Towards the end of 2004 further cases came to light, some of which could have fundamental impacts on future enforcement of EU law and waste management practices. The Commission has extensive powers to take legal action against member states that, in its view, are not fulfilling their obligations to implement EU laws. Successive failures to address alleged non-compliances can lead to hefty financial penalties. Two recent cases have attracted particular attention due to their potentially far-reaching impacts. Both cases are currently subject to published opinions by an EU Advocate General, which are published as a preliminary to the final ECJ ruling.
