摘要

The EC published its proposed Regulation for the Registration, Evaluation, Authorisation and Restriction of Chemicals (the "REACH" Regulation) in October 2003. The REACH Regulation is primarily aimed at the chemical and manufacturing industries and is currently one of the most highly contentious pieces of proposed legislation. It is being fiercely opposed by chemical and other manufacturers and by various Government ministries. The proposed Regulation is not written in industry specific terms and there is a possibility that it would catch products made from recycled or reused waste. If so, this might cause the waste recycling industry a major headache principally because the raw material (i.e. waste) comes from diverse sources with no information as to chemical makeup. The proposed REACH Regulation is very complex, and it is not possible in the context of this article to set out all of the relevant provisions. The comments below will, however, give a flavour of some of the difficulties with the proposed Regulation.
