This month our legal experts consider the hot topic of public resistance to waste management facilities and projects. Most people who have been involved in the waste management industry for any length of time will be aware of the power of the 'NIMBY' principle - not in my back yard - to delay, frustrate and even destroy efforts to build new waste management infrastructure (or improve existing infrastructure). Understandably, members of the public will frequently go to great lengths to resist new or enlarged waste management facilities near their homes. This public resistance to waste management infrastructure near to residential areas gives rise to a dilemma for the regulatory decision-makers (i.e. the environmental regulator and the planning authority). On the one hand, the authorities must consider the concerns of members of the public, e.g. worries over air or noise pollution; nuisance caused by odours; and increased traffic pressure caused by waste carriers (the NIMBY element). On the other hand, there is the proximity principle, according to which waste should normally be disposed of as near as possible to its place of origin. For example, according to the proximity principle, municipal waste should normally be disposed of close to the municipality where it was generated.
