On 8th August, DEFRA published its second consultation paper on EC Directive 1999/31/EC on the Landfill of Waste (the "Landfill Directive"). The consultation paper focuses on how the Government intends to implement the Landfill Directive (i.e. how the obligations created in the Landfill Directive will be "transposed" into UK law) and contains a set of draft regulations (the "Landfill (England and Wales) Regulations 2001"). The consultation paper is a lengthy document, and a complete analysis of it is beyond the scope of this column. However, we intend to comment in more detail on the draft regulations in the next issue. In the meantime, it is possible to make some initial comments.
