Those who would attempt to protect the environment through the courts are striving mightily to carve out a mandate from the existing provisions of our [federal] Constitution. . . . Such claims, even under our present [federal] Constitution, are not fanciful and may, indeed, some day, in one way or another, obtain judicial recognition. [W]e are free, and we are under a duty, to develop additional constitutional rights and privileges under our [state] Constitution if we find such fundamental rights and privileges to be within the intention and spirit of our local constitutional language and to be necessary for the kind of civilized life and ordered liberty which is at the core of our constitutional heritage. We need not stand by idly and passively, waiting for constitutional direction from the highest court of the land. Instead, we should be moving concurrently to develop and expound the principles embedded in our [state] constitutional law.
