BREXIT will not change the United Kingdom’s obligations in complying with existing sanctions, members attending 19th Annual CCS’ Economic Crime Lecture in London last month were told. David McLean, Head of Financial Sanctions Enforcement from OFSI (the Office of Financial Sanctions Implementation which is part of HM Treasury in the UK) said the UK will continue to implement United Nations sanctions when the country leaves the European Union. “The Sanctions & Anti-Money Laundering Act 2018 (SAMLA) received Royal Assent in May 2018 and the Act provides the legal basis for the UK to impose, update and lift sanctions after leaving the EU. If the UK leaves the EU without a deal, we will look to carry over all EU sanctions regimes at the time of our departure,” McLean told the audience. “Threats won’t change after the UK leaves the EU and the government will continue to work with EU and international partners post Brexit,” he added. A question was raised as to why financial institutions should be concerned about complying with EU sanctions because compared to the aggressive approach taken by the United States to sanctions at policy and implementation levels, the approach taken by the EU was relatively muted. An example of this was when SWIFT suspended Iranian banks from its payment networks, yet there was complete inaction by the EU.
