In Branzburg v. Hayes, the Supreme Court of the United States determined that the First Amendment to the Constitution does not protect privileged relationships between journalists and their sources, in which journalists could promise news sources anonymity and the judiciary could not pierce that shield. With its ruling, the Court all but invited state legislatures and Congress to do what the Court did not. Backed by the seminal legal scholarship of Vince Blasi (published a year prior to the Branzburg ruling) and lobbied by the media and state press associations, thirty-nine states and the District of Columbia, have done just that.
