Last year, $2,653 trillion in new mortgage loans were originated in the United States. A substantial number of these mortgages were recorded in the land records of one of approximately 3,600 counties, cities, or other municipalities, using a land records system that dates back to the 17th century and that largely relies on accepting paper documents (deeds or other documents affecting title to real property) for recordation. Fairly recent legal advances in the form of the Uniform Electronic Transactions Act (UETA) and the Electronic Signatures in Global and National Commerce Act (ES-IGN) now empower county recorders to accept electronic documents. In fact, recorders in approximately 65 counties in several states have already begun recording electronic documents.
