An increasingly digital world constantly puts electronic PHI at risk. The federal trilogy of HIPAA. HITECH, and the Omnibus Rule, as well as Texas' House Bill 300, created a complex set of requirements that work together to ensure health information remains private and protected. In particular, the HIPAA Security Rule establishes a variety of safeguards to protect electronic PHI from inappropriate and unauthorized use or disclosure.219 Thus, covered entities can better ensure the security of PHI, protecting not only the patient's information but also safeguarding the covered entity from costly fines and penalties, by assessing the potential risks and implementing the necessary administrative, physical, and technical procedures.
