In the Fall 2010 Federal Regulations Update (Employment Relations Today, Volume 37, Number 3), we focused considerable attention on the ambitious legislative agenda that the Department of Labor (DOL) had issued for the spring of 2011. With the notable exception of several significant Employee Retirement Income Security Act (ERISA)-related rules promulgated by the Employee Benefits Security Administration (EBSA), which are discussed later, little of the DOL's spring 2010 regulatory agenda has been implemented to date. Indeed, several of the most significant initiatives that the DOL had slated for notices of proposed rulemaking (NPRMs) in 2010 have been pushed back to dates later this year. For example, the DOL had planned to issue an NPRM for its initiative titled "Right to Know Under the Fair Labor Standards Act" (initially labeled the "Amendments to the Fair Labor Standards Act [FLSA] Recordkeeping Regulations") in August 2010 but has since advised that the NPRM is now scheduled for April 2011. The prototype for the DOL's "Plan/Prevent/ Protect" initiative—the Occupational Safety and Health Administration's (OSHA's) Injury and Illness Prevention Program (or I2P2)—still has not been scheduled for an NPRM.
