A federal judge has rejected EPA's effort to block environmentalists' suit challenging the agency's refusal to craft asbestos reporting rules under the Toxic Substances Control Act (TSCA), a potentially precedent-setting ruling that could further bolster plaintiffs' efforts seeking to challenge EPA petition denials. Judge Edward Chen of the U.S. District Court for the Northern District of California Nov. 15 denied EPA's motion to dismiss Asbestos Disease Awareness Organization (ADAO) et al v. Wheeler, finding in the first-of-its-kind decision that environmentalists could pursue their challenge under the Administrative Procedure Act (APA).
