EPA is formally rejecting a petition from a whistleblower group seeking more stringent hazardous waste regulation of corrosive dust, five years after the agency first proposed to deny a petition driven by concerns stemming from adverse health effects due to the collapse of the World Trade Center (WTC) after the 9/11 attacks. The petition denial, scheduled to be published in the June 15 Federal Register, reiterates many of the same reasons the agency gave in a tentative 2016 denial of the petition and notes the likely negative effects stricter standards would pose for the municipal wastewater treatment process at publicly owned treatment works (POTWs). EPA's notice responds to a 2011 petition from Public Employees for Environmental Responsibility (PEER) and EPA chemist Cate Jenkins requesting revision of the Resource Conservation and Recovery Act (RCRA) corrosivity hazardous waste characteristic regulation.
