The Supreme Court is poised to consider later this month whether to accept a case seeking to overturn a novel ruling by the U.S. Court of Appeals for the 10th Circuit that the nuclear industry says conflicts with other circuits and would make it vulnerable to potentially extensive liability under state tort laws for radioactive releases into the environment. Amid parties in the case say the 10th Circuit decision does "an end-run around the ... entire nuclear liability regime" established by federal law.
