Energy industry sources are raising concern over EPA's "next generation" strategy of innovative compliance approaches for the sector, questioning the agency's consideration of one method that would endorse the purchase of a particular type of emissions control equipment as qualifying as compliance with a pending revised air rule. The "obvious push-back" on such a plan would be industry opposition to EPA backing a particular company's air pollution control product, one industry source says, because it would give the manufacturer a "leg up on everyone else" making similar types of emissions reduction devices. Any next generation strategy built into the upcoming rule should ensure that alternative options for compliance remain available for industry to use, the source says. One environmentalist says that advocates would "need substantial reassurances" that the equipment operates as intended with little margin for error depending on how it is installed and operated. EPA would also have to explain why the compliance burden of a more traditional type of compliance would be prohibitive. "Otherwise, you're taking a big risk that the equipment does in fact operate as it's intended to," the environmentalist says.
