A Republican House member is conceding that his party likely lacks the votes to block EPA's high-profile climate regulations for power plants, but other lawmakers at a recent hearing attempted to build a record to help pending legal challenges targeting rules for both new and existing plants. During a Feb. 25 joint hearing of two House Energy & Commerce subcommittees on EPA's fiscal year 2016 budget request, Rep. David McKinley (R-WV) told EPA Administrator Gina McCarthy that the agency "has the ultimate power to issue any regulation" authorized by statute, and that "Congress doesn't... have the votes here to be able to overturn them."
