Environmentalists are pushing new petitions asking EPA to invoke little-used Clean Water Act (CWA) authority to require discharge permits for stormwater at a host of commercial and industrial developments across the United States, targeting specific watersheds after the agency rejected prior petitions seeking controls on a broader scale. In four petitions filed Sept. 17 with EPA Regions 3 and 9, the Natural Resources Defense Council (NRDC) and American Rivers ask the agency to use its CWA section 402(p)(2)(e) "residual designation authority" (RDA) to mandate stormwater discharge permits for "commercial, industrial, and institutional" properties in Maryland, California and Delaware on the grounds that runoff in each area contributes to known water quality problems.
