Environmentalists are informally dropping their push for EPA to set a first-time greenhouse gas (GHG) standard for refineries and will not enforce a settlement committing the agency to issue a rule, after EPA indefinitely delayed the rule and advocates are pursuing GHG limits at higher-emitting sources, including power plants and oil and gas drilling. Industry sources say EPA officials have been telling them that the agency has "dropped" the refinery GHG new source performance standards (NSPS) from its regulatory agenda at least in the short term in part due to budget constraints, and that the 2010 legal pact requiring the rules is essentially dead. EPA entered into the pact with several states and environmentalists who had sued the agency to force development of a refinery GHG NSPS. A separate settlement signed on the same day required the climate NSPS for power plants that EPA is working on, though the agency missed the original deadlines laid out in that settlement.
