EPA has sent its final rule banning state exemptions from air emissions limits during periods of startup, shutdown and malfunction (SSM) for White House Office of Management and Budget (OMB) review, the final step before publication, amid uncertainty over how the rule will respond to a recent appeals court decision banning similar exemptions protected by an "affirmative defense" policy the agency intended to serve in lieu of SSM. The rule, known as a state implementation plan (SIP) call, proposed to require the 36 states that have SSM exemptions in their SIPs to revoke the policies. OMB received the draft final version July 23, according to OMB's website, triggering an internal review period that would normally take several weeks prior to publication in the Federal Register.
