Despite federal funding limits and other hurdles, a growing number of states are considering asking federal officials for authority to issue dredge-and-fill permits under the Clean Water Act (CWA), a move that would expand EPA scrutiny of the permits and create a patchwork of local rules for many industries that rely on the permits for developing resources. "There are a lot of reasons you can argue that it's a good thing- the state agency is going to have a better grasp of local conditions than federal regulators. But it adds to the complexity of these programs for people who have to deal in more than one state," an industry source says.
