Environmentalists who are fighting efforts to expand coal exports are threatening to sue industry groups over the water pollution impacts of transporting the fuel and its byproducts, indicating they will seek a court ruling that rail cars carrying coal and other pollutants are "point sources" requiring discharge permits under the Clean Water Act (CWA)- though the environmentalists admit that the cars may be "unpermittable." In an April 2 letter, Sierra Club and several other groups notify Burlington Northern Santa Fe Railroad (BNSF), Peabody Energy and other businesses of their intent to file a lawsuit in federal court holding the companies responsible for alleged ongoing CWA violations stemming from releases of coal, coal chunks, coal dust and other "pollutants" from rail cars. (Doc ID: 2429758) Brett VandenHeuvel, executive director of Columbia Riverkeeper, said on an April 2 press call discussing the threatened suit that the group believes rail cars are covered by the CWA definition of "point source," which includes "rolling stock" in its list of conveyances that can require National Pollutant Discharge Elimination System (NPDES) permits.
