Agriculture groups fighting EPA's efforts to dismiss a landmark lawsuit over whether air releases from livestock farms are subject to Clean Water Act (CWA) permitting are arguing the issue is far from settled, pointing to agency statements and action in other cases the groups say reflect a broad agency policy that such releases must be permitted. Although EPA has withdrawn the CWA compliance order that is the subject of the litigation in Lois Alt v. EPA and is urging the federal district court to dismiss the suit on mootness grounds, industry groups say in their latest round of court filings that the agency fails to meet the legal bar for showing that the issue is moot.
