Environmentalists are urging a federal appeals court to scrap a 15-year-old EPA rule issued under the Resource Conservation & Recovery Act (RCRA) that allows fuel derived from hazardous waste to be burned in lesser-regulated industrial boilers, rather than more strictly regulated incinerators, if it is "comparable" to fossil fuel. The Natural Resources Defense Council (NRDC) and other environmental groups on July 8 filed their opening brief in long-delayed litigation in the U.S. Court of Appeals for the District of Columbia Circuit, arguing that EPA made several major flaws in its RCRA "Comparable Fuels Exclusion" rule that merit it being scrapped.
