The new appellate ruling requiring EPA to better justify why it did not set a unique "secondary" ozone standard to protect the environment from high ozone levels appears likely to force the agency to develop distinct health and environmental standards when crafting other air standards in the future, complicating permitting and regulatory burdens as states and industry seek to demonstrate compliance with an additional measure. "It is hard to see how EPA could justify setting the secondary standard the same as the primary" in any national ambient air quality standard (NAAQS) review where scientific evidence points to harmful effects to the environment, says one environmentalist attorney.
