The Defense Department (DOD) is once again seeking an exemption from EPA under the Toxic Substances Control Act (TSCA) to import into the United States for disposal more than 1 million pounds of polychlorinated biphenyl (PCB) waste generated by military activities in Japan. DOD lists several reasons EPA should grant the exemption ~ the third DOD has sought in recent years — to import the waste from U.S. installations, including that Japan lacks sufficient treatment and disposal capacity to handle the waste, the increased risks of storage in Japan as capacity becomes more limited and that the application to dispose of the materials in the United States "meets the statutory standard that 'no unreasonable risk' may result from the grant of an exemption under TSCA Section 6(e) authority," the Defense Logistics Agency (DLA) says in its petition sent in late April.
