The Sierra Club is urging EPA to start a two-year "clock" after which the agency would impose federal emission control plans on states lacking viable plans to curb interstate transport of air pollution, even though such a move would disregard a key portion of the appellate court ruling that scrapped EPA's latest air transport regulation. The request — which aims to have EPA impose a federal implementation plan (FIP) on states in which the agency directly writes plans to curb interstate emissions — poses the latest test of EPA's power to take over state air planning programs. The U.S. Court of Appeals for the District of Columbia Circuit could rule soon in a suit over an EPA FIP in Texas after that state refused to implement the agency's greenhouse gas permitting program.
