State regulators are weighing options for promulgating best practices for hydraulic fracturing operations to ensure health and environmental protections continue to improve absent EPA or other federal regulation, but some acknowledge that seeking voluntary industry adoption of the practices, or pushing industry beyond a regulatory "floor," can be difficult to achieve. During a July 11 Environmental Council of the States (ECOS) conference, "The Path to New Energy: Hydraulic Fracturing Focus," many speakers emphasized the need for states to continue to take the lead in overseeing fracking but detailed steps that should be taken to ensure state oversight remains effective.
