The difficulty underscores long-standing calls from some industry lawyers for EPA and states to craft a waiver to allow voluntary use of AMD, though the agency has long struggled to provide adequate liability protection for innocent parties that seek to voluntarily clean up abandoned mine sites from which the AMD is drawn.
