Power plant operators claim EPA's recent notice of data availability (NODA) for its long-delayed coal ash disposal rule bolsters the sector's claims that the best approach for the agency to take is a least-stringent solid waste rule that would not require some disposal sites to close or install liners, because the data show low risks at existing facilities. In Sept. 3 comments to EPA, a coalition of industry groups including the Utility Solid Waste Activities Group (USWAG) and the Edison Electric Institute say the data - which EPA will use to inform a pending coal ash risk assessment - "reaffirm" the call for the less strict of two proposed Resource Conservation & Recovery Act (RCRA) subtitle D solid waste regulatory options for coal ash known as subtitle D "prime," saying the information shows the risks from ash disposal do not warrant subtitle C hazardous waste rules that environmentalists want.
