Judge Rejects Commerce Clause Attack On California Drug Take-Back Plan

A federal judge has rejected pharmaceutical groups' claims that a California county's novel ordinance requiring drug manufacturers to finance medication take-back programs violates the U.S. Constitution's Commerce Clause, upholding the program after finding it does not directly regulate interstate commerce. Supporters of the Alameda County, CA, program expect industry to appeal the ruling. The three industry groups that sued over the ordinance - Pharmaceutical Research and Manufacturers of America (PhRMA), Generic Pharmaceutical Association and Biotechnology Industry Organization-say in a joint Aug. 30 statement they "remain confident in our legal position, and will review the opinion thoroughly as we determine the appropriate next steps."
