A federal district court has rejected environmentalists' novel suit that aimed to block a Clean Water Act (CWA) dredge-and-fill permit for a Kentucky mountaintop mining operation by claiming the Army Corps of Engineers failed to adequately consider cancer and other adverse human health effects from the facility before it granted the permit. But the U.S. District Court for the Western District of Kentucky, Louisville Division, also issued a temporary order preventing the mining activity from beginning under the permit until it has ruled on environmentalists' request seeking a preliminary injunction to block the mine while they appeal the court's Aug. 23 ruling rejecting the suit. The decision means that, for now, the Corps can continue to limit the scope of mountaintop mining permit reviews to adverse health and environmental impacts from the "fill" waste material produced by the operations, rather than a broader mining facility-wide review that environmentalists had hoped to force under the lawsuit.
