Environmentalists and states supportive of a stricter ozone national ambient air quality standard (NAAQS) are urging a federal appeals court panel to rehear its decision upholding the agency's 2008 ozone NAAQS, saying the court erred by failing to ensure that EPA's standard met an "adequate margin of safety" to protect public health. The U.S. Court of Appeals for the District of Columbia Circuit three-judge panel's July 23 opinion upholding the primary, health-based ozone standard "fails to address a critical defect in EPA's ozone NAAQS decision - namely, the agency's complete failure to explain how the health standard provided an adequate margin of safety to sensitive populations," as required under the Clean Air Act, environmentalists say in a Sept. 6 rehearing petition.
