EPA is proposing a third phase of its greenhouse gas (GHG) permit "tailoring" rule that would retain existing GHG permit thresholds rather than softening them due to states' limits on implementing the existing GHG permit program, while also proposing steps to streamline permit processing that could draw the ire of some activists. The agency Feb. 24 released its "Step 3" tailoring proposal, following Step 1 that took effect Jan. 2, 2011 and set a first-time threshold of 75,000 tons per year (tpy) for sources already subject to PSD for non-GHG pollutants. In the Step 2 rule, which took effect last July 1, EPA introduced a threshold of 100,000 tpy for those sources not subject to the program for conventional pollutions. Step 3 was widely expected to seek to further reduce the thresholds. Relevant documents are available on InsideEPA.com. See page 2 for details.
