EPA Appears To Grant Flexibility For State UIC Permits For Diesel Fracking

EPA has agreed to drop informal policy language requiring hydraulic fracturing operations that use diesel fuel in their injection fluid to seek strict underground injection control (UIC) permits, a move that could provide states with more flexibility in determining which UIC regime to use once EPA issues upcoming guidance on the issue. Such permitting flexibility may be disappointing for environmentalists who have urged the administration to ensure that the upcoming guidance recommends strict monitoring and other requirements for permitting fracking operations as a way to encourage states that develop their own rules to adopt such approaches. In a Feb. 23 settlement, the agency agreed to scrap 2010 policy language from its website that maintains that "Injection wells receiving diesel fuel as a hydraulic fracturing additive will be considered Class II wells by the UIC program."
