Two Washington state localities are asking a federal district court to rule on whether a law Congress passed early in 2011 to require federal facilities to pay local stormwater fees applies to fees that localities assessed prior to the law's passage, a ruling that will have national implications for local agencies' ability to collect fees from federal installations. The cities of Renton and Vancouver, WA, filed a motion Feb. 7 asking the U.S. District Court for the Western District of Washington to grant partial summary judgment on the issue in United States of America v. City of Renton, et al. The two cities are asking the court to rule that legislation passed by Congress last year confirms Congress' intent to waive federal agencies' sovereign immunity to "reasonable service charges" levied by municipalities for stormwater control not just prospectively, but also for fees charged prior to its passage.
