EPA's Environmental Appeals Board (EAB) has rejected requests from EPA and oil giant Shell to reverse its earlier ruling in a case remanding clean air permits for drilling off Alaska's coast, opening the door to a precedent requiring EPA to limit greenhouse gases (GHG) and other pollutants that were regulated after the permit was first issued. In a Feb. 10 order in In Re: Shell Gulf of Mexico Inc. and Shell Offshore Inc., the board also allowed that EPA could exercise its discretion when it reconsiders the permit to determine whether it will regulate GHGs and other newly regulated pollutants.
