EPA Faces Challenges To Key Definition Underpinning Air Transport Rule

EPA's cap-and-trade program to cut utilities' emissions faces administrative and legal challenges to a key definition that underpins the entire rule on whether some states' emissions have a "significant contribution" to downwind states' failure to meet or maintain agency air standards, and a legal loss for EPA could force a massive overhaul of the rule. The challenges raise questions over whether the agency's Cross-State Air Pollution Rule (CSAPR) trading program adequately responds to a U.S. Court of Appeals for the District of Columbia Circuit ruling in 2008 that remanded a Bush-era predecessor of the rule to EPA due to concerns about the legality of several provisions. The Obama EPA has repeatedly said that CSAPR is a legally and environmentally defensible replacement for the Bush-era rule.
