EPA appears likely to formalize a long-standing agency position that nanoscale versions of conventional ingredients in pesticides be considered as "new active ingredients" under the agency's pesticide program, but one informed source says there are still questions whether EPA will apply the new policy retroactively to materials in existing formulations. The move suggests the agency is likely to grant environmentalists' call in a high-profile petition filed last year asking for increased regulation of nanonsilver - a widely used nanomaterial which has antimicrobial properties - under pesticides law, which is generally considered more stringent than toxics law, sources say.
