Outgoing EPA General Counsel Roger Martella is strongly defending the agency's litigation record in response to concerns from House Oversight & Government Reform Committee Chairman Henry Waxman (D-CA) that the agency has lost a large number of challenges to major regulations. In an April 18 response to an earlier Waxman request for information, Martella defends the agency's track record in the courts by saying EPA has won a host of court cases, for example by winning three out of five cases involving the agency before the Supreme Court in the last two years.
