Peer reviewers of a draft EPA risk assessment on coal combustion waste (CCW) disposal are divided over whether the data underestimates risk from the waste, heightening a long-running split between industry, states and activists over the risk level and making it more difficult for EPA to determine the need to regulate CCW disposal. One industry source says that while the risk assessment is "a neat intellectual exercise it certainly isn't definitive in terms of defining your regulatory path forward" and says that any federal regulation of coal waste based on the assessment would fail to acknowledge varying conditions at different disposal sites. In contrast, an environmentalist says that the split among the peer reviewers - including separate comments that alternately say EPA is overestimating and underestimating risk - shows the need to revise the assessment in line with the reviewers' recommendations for improvements.
