EPA's rejection of an activist petition asking the agency to reconsider its new rule exempting waste generated by petroleum refineries from federal waste regulations if it is burned as fuel opens the door for pending litigation over the rule-held in abeyance until EPA responded to the petition-to proceed. EPA waste chief Susan Bodine sent a Nov.14 letter to activists rejecting their April 1 petition challenging the agency's new regulation for oil-bearing hazardous secondary materials from the petroleum refining industry processed in a gasification system to produce synthetic gas,which the agency finalized Jan.2.The rule broadens industry's ability to burn as fuels wastes typically subject to strict federal rules.
