EPA's Environmental Appeals Board (EAB) is requiring the agency to conduct a landmark Clean Air Act review to determine whether to set first-time carbon dioxide (CO2) limits in an emissions permit, a decision likely to stifle new coal-fired power plants across the country until EPA completes the review. The ruling sends the issue to the incoming Obama administration, which is vowing to take steps to regulate CO2 emissions under the air act if Congress does not act. The ruling is available on InsideEPA.com. Seepage 2 for details. "Essentially, all EPA's rationales for not imposing [best available control technology (BACT) limits] for CO2 are demolished.... It's been sent back to EPA, and the Obama administration will be writing the new rules for coal-fired power plants," an environmental attorney involved in the permit challenge says. However, industry officials are accusing environmentalists of "over-reading" the ruling, charging that nowhere in EAB's ruling does the board mandate that permits must include CO2 limits. Regardless of industry's claims, activists are touting the ruling because it means EPA must at least conduct an analysis of potential CO2 BACT limits.
