EPA's recent, first-time successful criminal prosecution of a company for failing to meet Clean Air Act risk management plan (RMP) requirements designed to prevent incidents at major facilities may signal an agency attempt to take a stronger role on security issues, observers say. But the observers also agree that EPA is unlikely to gain any new authority next year when the 11 lth Congress is expected to enact broad new legislation next year to establish permanent security regulations for chemical facilities to be led by the Department of Homeland Security (DHS). The EPA prosecution shows that the agency wants to play a constructive role in securing facilities against major accidents or terrorist attacks, one environmentalist says, adding the action could act as a deterrent to ensure other companies adhere to the RMP requirements.
