Critics Eye New Legislative Options To Block Epa's 'midnight' Rules

Environmentalists and other critics of last-minute Bush administration regulations are formulating some new options to block EPA and other agencies' "midnight regulations" because of concerns that the Congressional Review Act (CRA) -the federal law that allows lawmakers to overturn regulations-may not be the best mechanism to quickly block the large number of regulations. Although the CRA gives Congress 30 to 60 legislative days to review and reverse agency rules, sources say they are weighing other legislative options because an omnibus CRA measure could trigger lengthy congressional debate and it is unclear whether the law will allow lawmakers to bundle several resolutions of disapproval into a single package. Among the emerging legislative strategies being considered is a bill that would extend the effective date of controversial regulations to give the incoming administration more time to delay and revise the rules or a bill to simply reverse a suite of rules without using lawmakers' CRA authority.
