Wastewater treatment industry representatives are seeking to resist stricter Clean Water Act (CWA) requirements by arguing that the technologies needed to meet the water act limits require increased energy consumption resulting in higher levels of greenhouse gas (GHG) emissions. At a National Association of Clean Water Agencies (NACWA) law conference in Washington, D.C., Nov. 12-14, Fred Andes, an attorney who represents publicly owned treatment works (POTWs), advocated looking at a wide variety of venues where GHG impacts from stricter water rules could be considered in regulating dischargers. Andes noted, for example, that EPA is pushing Idaho regulators to strengthen the water quality standard for phosphorous on the Lower Boise River from 200 micrograms per liter (ug/1) to 70 ug/1. But he argued that the stricter standard would result in an additional 6,200 metric tons of carbon dioxide (CO2) emissions per year because of the increased power needs of the wastewater treatment plant.
